zatillo.com is a brand of Zatillo and is part of the Zatillo group of websites and companies.

These terms and conditions govern your use of all apps, websites and other information providing or interactive electronic media published by us (“Websites”). Please read these terms before you use our Websites. If you do not accept these terms, please do not use any of our Websites. Using any of our Websites implies that you accept these terms. We do occasionally update these terms so please refer back to them in the future. References to “us” and “us” (and similar expressions) in these terms and conditions are references to Zatillo.


1. SITE ACCESS

1.1 Zatillo offers access to the majority of its Websites without requiring users to register any details. However, particular areas of the Websites will only be accessible, including the ability to apply for any jobs, only following registration.
 

1.2 Jobseekers may upload a CV or Resume (“Resume”) during registrations.
 

1.3 You represent and warrant that all information provided by you to Zatillo and all details included in any you upload Resume is true and accurate in all material respects and not materially misleading by reason of omission.
 

1.4 Resumes may be published on our Websites and will be visible to those people to whom we grant access. You may edit information you provide and also update your Resume. Please ensure that only data you are happy sharing is contained in your Resume.
 

1.5 If you select (or do not de-select) our “Jobs-By-Email” feature then emails may be sent to you giving details of job opportunities which it appears to us may be relevant to you (based on the skills, qualifications and other information that you have provided).
 

2. USE OF WEBSITES

2.1 The content of our Websites is intended for information purposes only and not to constitute advice. We do not guarantee the accuracy of the content of our Websites and you should conduct your own due diligence as to the veracity of any information on any of them. Please use your own judgement before acting on the basis of what you see. Unless expressly stated in writing by us or required by law, we make no representations and give no warranties of any kind in relation to any information on any of our Websites.
 

2.2 You are permitted to use our Websites for your own purposes and to print and download material from them for your personal use only (subject always to the proviso that you do not modify any content without our consent). The content on our Websites (and information gleaned from such content) may not be used for any commercial purpose or republished (whether online or offline) without our express permission. No part of our Websites may be reproduced without our prior written permission.
 

2.3 The copyright and other intellectual property rights in all material on our Websites are owned by us or our licensors and must not be reproduced, used or relied on without our prior consent. Nothing in the licence granted by or pursuant to these terms and conditions operates to transfer any intellectual property rights (including but not limited to copyright, trademarks, service marks, design rights (whether registered or unregistered), patents, know-how, trade secrets, inventions, get-up, database rights and any applications for the protection or registration or these rights (and all renewals and extensions of any of these) existing in any part of the world whether now known or created in the future) from Zatillo to any person. You agree that intellectual property in the Websites, the underlying software and algorithms and materials accessed or used by the Websites is owned by Zatillo or its licensors, and you agree not to use any of those materials in a way that infringes the rights of any owner of intellectual property rights in them.
 

3. VISITOR CONDUCT

3.1 With the exception of personally identifiable information, the use of which is covered under our Privacy Policy, any material you send or post to our Websites shall be considered non-proprietary and not confidential (and you authorise us to publish, repurpose or otherwise deal as we decide with such information) and by providing materials to us you authorise us and grant us a licence to retain, use, redact, extract and modify the materials and information included in them in such way as we deem appropriate. Unless Zatillo agrees with you to the contrary in writing Zatillo will be free to copy, disclose, distribute, incorporate and otherwise use such material for any and all purposes.

3.2 You agree that if you include personal information in a Resume you submit to us, that personal information may be published by us.

3.3 When using our Websites you shall neither post or send, to-or-from our Websites, any material:

3.3.1 for which you have not obtained all necessary consents;

3.3.2 that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in the United Kingdom (or any other place where you reside or seek employment or to which the Websites are published);

3.3.3 which is harmful to Zatillo's property, operational effectiveness or business value. In particular, but not exhaustively: computer viruses, Trojan horses, spy-ware, scraping or crawling bots, corrupted data, or any other software or data which has the capacity, or potentially capacity, to be harmful to: Zatillo, or any of its associates' websites, or its business operational effectiveness, or product value, or clients.

3.4 YOU AGREE:

3.4.1 not to reverse engineer or to attempt to amend, copy or emulate any part of our Websites or underlying software and algorithms and/ or materials accessed or used by them and not to attempt to gain unauthorised access to any of our Websites or any connected system;

3.4.2 not to use our Websites to facilitate any illegal activity; and

3.4.3 not to onward provide any service facilitated by any of our Websites to any third party.

3.5 We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to our Websites in breach.

4 Links to and from other websites

4.1 Any links to third party websites located on our Websites are provided for your convenience only. We have not reviewed each third-party website and have no responsibility for such third-party websites or their content. We do not endorse the third-party websites or make representations about them or any material contained in them. If you choose to access a third-party website linked to from our Websites, it is at your own risk.

4.2 If you would like to link to our Websites, you may only do so on the basis that you link to, but do not replicate, any page on our Websites, and subject to the following conditions:

4.2.1 you do not in any way imply that we are endorsing any services or products unless this has been specifically agreed with us;

4.2.2 you do not misrepresent your relationship with us or present any false information about us;

4.2.3 you do not link from a website that is not owned by you;

4.2.4 your website does not contain content that is offensive, controversial, infringes any intellectual property rights or other rights of any other person or does not comply in any way with the law in the United Kingdom;

4.2.5 you agree that you shall remove (and not replace or substitute) any link that we request you remove.

4.3 If you choose to link to any of our Websites, you shall fully indemnify us for any loss or damage suffered as a result of your actions.

5 Disclaimer

5.1 We may take reasonable steps to ensure that the information on our Websites is correct. However, we do not guarantee the correctness or completeness of material on our Websites. We may make changes to the material on our Websites at any time and without notice. The material posted on our Websites may, on occasion, be out of date, or on rare occasions, contain incorrect information. We make no commitment to ensure that such posted material is always correct and/or up to date.

5.2 The material on our Websites is provided without any conditions or warranties of any kind outside those listed in this document. In the strictest legal sense, we provide access and use of our Websites on the acknowledgement by the user that the sites owners are held indemnified from any representations, warranties and conditions which are not covered in our terms and conditions document.

5.3 We take all reasonable steps to ensure that our Websites remain available and secure however we accept no liability if our Websites are unavailable at any time or if the security is breached (this disclaimer of liability does not derogate from your strict legal rights such as, for example, our liability resulting from our breach of applicable data protection laws).

5.4 You agree to indemnify Zatillo in respect of any loss caused by your breach of these terms and conditions.

6 Exclusion of liability

6.1 Zatillo has no liability in respect of damages resulting from loss of or use, lost profits, loss of anticipated savings, nor for any damages that are an indirect or secondary consequence of any act or omission by Zatillo, whether such damages were reasonably foreseeable or actually foreseen. Zatillo's total liability in contract, tort (including negligence or breach of statutory duty) or otherwise arising by reason of or in connection with these terms and conditions by Zatillo's negligence (or the negligence of Zatillo's employees while acting in the course of their employment) (except in relation to death or personal injury or other liability to the extent it may not be excluded by law) shall be limited to the aggregate of the amount paid to us by the person who suffers such loss. For the purposes of this clause 6 references to Zatillo include, where Zatillo so elects, Zatillo's employees, sub-contractors and suppliers (who shall then have all have the benefit of the limits and exclusions of liability set out in this clause).

6.2 Zatillo accepts liability in respect of (and nothing in these terms and conditions operates to exclude or limit liability for) (a) any fraud negligence (as defined by the Unfair Contract Terms Act 1977) or material misrepresentation made to you by Zatillo; and (b) death or personal injury caused by Zatillo's own negligence, (c) other liability which may not lawfully be excluded.

6.3 You expressly waive all (if any) rights which you may, but for these terms and conditions have, to seek compensation from Zatillo other than in respect of matters in respect of which Zatillo accepts liability as stated in paragraph 6.2. Neither we nor any other party (whether or not involved in producing, maintaining or delivering our Websites), shall be liable or responsible for any kind of loss or damage that may result to you or a third party as a result of your or their use of any of our Websites.

6.4 You agree that we may use your data (and data you collect) on an anonymous aggregated basis subject to the data protection provisions as set out in this agreement. Subject to the requirements of law we shall not be responsible for any loss, alteration or disclosure of your data.

7 Miscellaneous

7.1 References to “Zatillo” in the context of obligations owed to Zatillo or other benefits, indemnities, waiver or assurances given to Zatillo shall be deemed to include reference also to any company which is a subsidiary undertaking of Zatillo Limited (company number 12998294) (“subsidiary undertaking” having the meaning given to it in section 1162 of the Companies Act 2006).

7.2 We may amend these terms and conditions at any time. The amended terms and conditions will be binding on you the next time you access any of our Websites. We assume no obligation to alert you to any change to these terms and conditions. We may deny you access to the whole or any part of any our Websites at any time without giving any reason.

7.3 If any part or provision of these terms and conditions is found to be unlawful or unenforceable, this shall not affect the validity of any other part or provision.

7.4 These terms and conditions are governed by English law. The English courts shall have exclusive jurisdiction over any claim brought by you arising from, or related to, use of the Site and Services and these General Terms.
